Procedure

Enquiries can be made without obligation

The basic steps are : -

• Initial discussions to confirm the scope of the work and agree the fees

• Beneficiaries to apply for NIE numbers (if necessary) and sign a "Poder de Representación" (a Power of Representation) to enable the lawyers in Spain to act. This may involve a visit to the Spanish consulate or a local notary.

• Pay the lawyer's fees in Spain. This may be in £ Sterling through the UK banking system

• Provide certain information (details of beneficiaries, etc) and documents (for example, death certificates)

• Sign and return certain documents as requested

• When due, make a second payment to cover the Spanish Inheritance Tax, the Spanish Notary's and the Land Registry fees.

Timescale

Probate can usually be achieved within two months of the finalisation of all documentation and the payment of the second tranche of money.

We often find that the timescale is dictated by the processing of applications for NIE numbers.

It is therefore essential that this is started early in the process, but please agree the exact procedure with the lawyers before you start your own application.
